يَا أَيُّهَا النَّبِيُّ لِمَ تُحَرِّمُ مَا أَحَلَّ اللَّهُ لَكَ تَبْتَغِي مَرْضَاتَ أَزْوَاجِكَ وَاللَّهُ غَفُورٌ رَّحِيمٌ

Yã kai Annabi! Don me kake haramta abin da Allah Ya halatta maka,(1) kanã nħman yardar mãtanka, alhãli kuwa Allah Mai gãfara ne, Mai jin ƙai.

O Prophet! Why holdest thou to be forbidden that which Allah has made lawful to thee? Thou seekest to please thy consorts. But Allah is Oft-Forgiving, Most Merciful.
O Prophet! why do you forbid (yourself) that which Allah has made lawful for you; you seek to please your wives; and Allah is Forgiving, Merciful.
O Prophet! Why bannest thou that which Allah hath made lawful for thee, seeking to please thy wives? And Allah is Forgiving, Merciful.

Asbabu n-Nuzuul (Occasions of Revelation)

(O Prophet! Why bannest thou that which Allah hath made lawful for theeナ) [66:1]. Muhammad ibn Mansur al-Tusi informed us> Ali ibn Umar ibn Mahdi> al-Husayn ibn Ismail al-Mahamili> Abd Allah ibn Shabib> Ishaq ibn Muhammad> Abd Allah ibn Umar> Abul-Nadr, the client of Umar ibn Abd Allah> Ali ibn Abbas> Ibn Abbas> Umar who said: モThe Messenger of Allah, Allah bless him and give him peace, entered the house of Hafsah along with the mother of his son, Mariyah.
When Hafsah found him with her [in an intimate moment], she said: Why did you bring her in my house? You did this to me, to the exception of all your wives, only because I am too insignificant to you. He said to her: Do not mention this to Aishah; she is forbidden for me [i.e. Mariyah] if I ever touch her. Hafsah said: How could she be forbidden for you when she is your slave girl? He swore to her that he will not touch her and then said: Do not mention this incident to anyone.
But she went ahead and informed Aishah. The Prophet, Allah bless him and give him peace, decided not to go to his wives for a month. He stayed away from them twenty nine days when Allah, glorious and exalted is He, revealed (O Prophet! Why bannest thou that which Allah hath made lawful for thee, seeking to please thy wives?)ヤ. Abu Ibrahim Ismail ibn Ibrahim al-Waiz informed us> Bishr ibn Ahmad ibn Bishr> Jafar ibn al-Hasan al-Firyabi> Minjab ibn al-Harith> Ali ibn Mushir> Hisham ibn Urwah> his
father> Aishah who said: モThe Messenger of Allah, Allah bless him and give him peace, used to like sweet and honey.
It was also his habit to go to his wives after finishing the Asr prayer. In one occasion he went to Hafsah bint Umar and stayed with her more than he usually did. When I found out about this, I enquired about the reason and I was told that a woman from her clan gifted her with a pot of honey which she offered to the Prophet, Allah bless him and give him peace. I said to myself: by Allah I will spoil it for him. I said to Sawdah bint Zamah: When he comes to your apartment and draws closer to you, say: O Messenger of Allah, did you eat Maghafir? When he says: Hafsah fed me some honey, say: The bees which produced it must have eaten the Urfut.
I will say the same thing, and you, Safiyyah, should say the same. Sawdah said: By Allah, the moment he stood at the door I was about to begin what she commanded me to do. When he drew closer to her she said: O Messenger of Allah, did you eat Maghafir? No! he replied. She said: Then, what is this smell on you? He said: Hafsah fed me some honey! she said: モThe bees which produced it must have eaten the Urfut. When he came to me, I said the same thing. And when he went to Safiyyah she also repeated the same thing. When it was Hafsahs turn and the Prophet went to her, she said to him: O Messenger of Allah, shall I feed you some of that honey? He said: I do not feel like it! Sawdah said: Glory be to Allah, we have deprived him [of honey]. But I said to her: Be quiet! ヤ This was narrated by Bukhari from Farwah ibn Abi al-Maghra, and also by Muslim from Suwayd ibn Said ; and both Farwah and Suwayd related it from Ali ibn Mushir. Abu Abd al-Rahman ibn Abi Hamid informed us> Zahir ibn Ahmad> al-Husayn ibn Muhammad ibn Musab> Yahya ibn Hakim> Abu Dawud> Amir al-Khazzaz> Ibn Abi Mulaykah who related that Sawdah bint Zamah had relatives from her mothers side in the Yemen who used to gift her honey. Among all the wives of the Prophet, Allah bless him and give him peace, Hafsah and Aishah were very close to each other. One of them said to the other: モDo you not see this? He goes to her when it is not her turn just to have some of that honey. So when he comes to you hold your nose, and when he asks you about the reason, say: I smell something in you that I do not know what it is. When he comes to me, I shall say the same thingヤ. When the Prophet, Allah bless him and give him peace, went to her she held her nose.
He asked her: モWhats wrong?ヤ She said: モI smell something in you and I think it is the smell of Maghafirヤ. The Messenger of Allah, Allah bless him and give him peace, used to put on him good perfume whenever he found it. When he went to his other wife and she said the same thing. He said: モSo-and-so said the same thing to me; this must be something that I ate at the house of Sawdah, and, by Allah, I will never eat it again!ヤ Ibn Abi Mulaykah reported that Ibn Abbas said: モThe verse (O Prophet! Why bannest thou that which Allah hath made lawful for thee, seeking to please thy wives?) was revealed about this [the incident reported above]ヤ.

Allah censures His Prophet for Prohibiting Himself from what He has allowed for Him In the Book of Vows

Al-Bukhari recorded that Ubayd bin Umayr said that he heard A'ishah claiming that Allah's Messenger used to stay for a period in the house of Zaynab bint Jahsh and drink honey in her house. (She said) "Hafsah and I decided that when the Prophet entered upon either of us, we would say,

`I smell Maghafir on you. Have you eaten Maghafir'

When he entered upon one of us, she said that to him.

He replied (to her),

لَا، بَلْ شَرِبْتُ عَسَلًا عِنْدَ زَيْنَبَ بِنْتِ جَحْشٍ وَلَنْ أَعُودَ لَه

No, but I drank honey in the house of Zaynab bint Jahsh, and I will never drink it again.''

Then the following was revealed;

يَا أَيُّهَا النَّبِيُّ لِمَ تُحَرِّمُ مَا أَحَلَّ اللَّهُ لَكَ تَبْتَغِي مَرْضَاتَ أَزْوَاجِكَ وَاللَّهُ غَفُورٌ رَّحِيمٌ ﴿١﴾

قَدْ فَرَضَ اللَّهُ لَكُمْ تَحِلَّةَ أَيْمَانِكُمْ وَاللَّهُ مَوْلَاكُمْ وَهُوَ الْعَلِيمُ الْحَكِيمُ ﴿٢﴾

وَإِذْ أَسَرَّ النَّبِيُّ إِلَى بَعْضِ أَزْوَاجِهِ حَدِيثًا فَلَمَّا نَبَّأَتْ بِهِ وَأَظْهَرَهُ اللَّهُ عَلَيْهِ عَرَّفَ بَعْضَهُ وَأَعْرَضَ عَن بَعْضٍ فَلَمَّا نَبَّأَهَا بِهِ قَالَتْ مَنْ أَنبَأَكَ هَذَا قَالَ نَبَّأَنِيَ الْعَلِيمُ الْخَبِيرُ ﴿٣﴾

إِن تَتُوبَا إِلَى اللَّهِ فَقَدْ صَغَتْ قُلُوبُكُمَا...

O Prophet!

Why do you forbid that which Allah has allowed to you, seeking to please your wives? And Allah is Oft-Forgiving, Most Merciful.

Allah has already ordained for you (O men) the absolution from your oaths. And Allah is your Protector and He is the All-Knower, the All-Wise.

And (remember) when the Prophet disclosed a matter in confidence to one of his wives, then she told it.

And Allah made it known to him; he informed part thereof and left a part.

Then when he told her thereof, she said: "Who told you this?''

He said: "The All-Knower, the All-Aware has told me.''

If you two turn in repentance to Allah, your hearts are indeed so inclined;

in reference to `A'ishah and Hafsah.

وَإِذْ أَسَرَّ النَّبِيُّ إِلَى بَعْضِ أَزْوَاجِهِ حَدِيثًا And (remember) when the Prophet disclosed a matter in confidence to one of his wives, which refers to this saying, بَلْ شَرِبْتُ عَسَلًا But I have drunk honey. Ibrahim bin Musa said that Hisham said that it also meant his saying,

وَلَنْ أَعُودَ لَهُ وَقَدْ حَلَفْتُ فَلَا تُخْبِرِي بِذَلِكِ أَحَدًا

I will not drink it anymore, I have taken an oath to that, therefore, do not inform anybody about it.

Al-Bukhari also recorded this Hadith in the Book of Divorce;

then he said,

"Al-Maghafir is a type of sap, and in Ar-Rimth (a type of citrus) its taste is sweet...''

Al-Jawhari said,

"The `Urfut is a tree of the shrub variety, which secretes Maghfur.''

Muslim collected this Hadith from A'ishah in the Book of Divorce in his Sahih, and his wording is the same as Al-Bukhari in the Book of Vows.

In the Book of Divorce, Al-Bukhari recorded that A'ishah said,

"Allah's Messenger liked sweets and honey. After performing the `Asr prayer, he used to visit his wives, going close to them. So he went to Hafsah, daughter of Umar, and stayed with her more than his usual stay. I (A'ishah) became jealous and asked about that. It was said to me,

`A woman of her family sent her a small vessel of honey as a gift, and she gave a drink to Allah's Messenger made from it.'

I said, `By Allah, we will contrive a plot against him.'

I said to Sawdah bint Zam`ah, `When the Messenger visits you and draws close to you, say to him, `Have you eaten Maghafir?' And when he says to you, `No', then ask him, `What is this odor?'

He will say to you, `Hafsah has given me a drink of honey.' Then you should say to him, `The honeybees might have eaten from Urfut, and I will also say the same to him. Safiyyah, you should also say this.'

Sawdah later said, `It was under compulsion that I had decided to state that which you told me; soon, by Allah, he was standing at my door.'

So when Allah's Messenger came near her, she said, `O Messenger of Allah! Did you eat Maghafir'

He said, `No.'

She again said, `Then what is this odor'

He said, سَقَتْنِي حَفْصَةُ شَرْبَةَ عَسَل Hafsah gave me honey to drink.

She said, `The honeybees might have eaten from `Urfut.'''

A'ishah continued, "When he came to me I said the same to him."

He then visited Safiyyah and she also said similar to him.

When he again visited Hafsah, she said, `O Messenger of Allah, should I not give you that (drink)?'

He said, لَا حَاجَةَ لِي فِيه I do not need it.

Sawdah said, `By Allah! We have prevented him from drinking honey.'

I said to her, `Keep quiet!'''

Muslim also recorded this Hadith, but this wording is from Al-Bukhari.

In the narration of Muslim, A'ishah said,

"The Messenger of Allah used to hate to have a bad odor coming from him''

This is why they suggested to him that he ate Maghafir, because it causes a bad odor. When he said, بَلْ شَرِبْتُ عَسَلًا No, I had some honey.

They said that the bees ate from a tree that is called Al-`Urfut, which has Maghafir gum, suggesting that this is the reason behind the bad odor they claimed was coming from him.

The latter narration, collected through Urwah from A'ishah, mentions that it was Hafsah who gave the Prophet the honey.

In another narration collected from `Ubayd bin `Umayr, from A'ishah, it was Zaynab bint Jahsh who gave the honey to the Prophet, while A'ishah and Hafsah were the plotters. Allah knows best.

Some might say that they were two separate incidents. However, it is not likely that the Ayat were revealed about both incidents, if indeed they were two separate incidents. Allah knows best.

A Hadith that Imam Ahmad collected in the Musnad mentions that A'ishah and Hafsah were the plotters.

Imam Ahmad recorded that Ibn Abbas said,

"I was eager to ask `Umar about the two ladies among the wives of the Prophet , about whom Allah said, إِن تَتُوبَا إِلَى اللَّهِ فَقَدْ صَغَتْ قُلُوبُكُمَا (If you two turn in repentance to Allah your hearts are indeed so inclined);

Then I performed Hajj along with Umar, and on our way back from Hajj he went aside (to relieve himself). I also went aside along with him carrying a tumbler of water. When he finished and returned, I poured water on his hands from the tumbler and he performed ablution. I said,

`O Commander of the faithful! Who were the two ladies among the wives of the Prophet, to whom Allah said, إِن تَتُوبَا إِلَى اللَّهِ فَقَدْ صَغَتْ قُلُوبُكُمَا (If you two turn in repentance to Allah your hearts are indeed so inclined),'

Umar said, `I am astonished at your question, O Ibn `Abbas.''' -

Az-Zuhri (a subnarrator) said that Umar did not like the question, but he still answered it, saying that they were `A'ishah and Hafsah."

Then `Umar went on relating the story and said,

`We, the people of Quraysh, used to have authority over our women. But when we came to live with the Ansar, we noticed that the Ansari women had the upper hand over their men, so our women started acquiring the habits of the Ansari women. At that time, I was residing at the house of Umayyah bin Zayd, in Al-Awali. Once I got angry with my wife, and she talked back to me; I disliked her answering me back. She said,

`Why do you dislike me talking back to you By Allah, the wives of the Prophet talk back to him, and some of them may not speak with him for the whole day, until nightfall.'

Then I went to Hafsah and asked her, `Do you talk back to Allah's Messenger'

She said, `Yes.'

I asked, `Does any of you keep Allah's Messenger angry all day long, until night?'

She replied, `Yes.'

I said, `Whoever among you does this is a ruined, losing person! Doesn't she fear that Allah may get angry for the anger of His Messenger and, thus, she will be ruined. Don't ask Allah's Messenger too many things, and don't retort him in any case. Demand from me whatever you like, and don't be tempted to imitate your neighbor, for she is more beautiful than you, and more beloved to Allah's Messenger than you.'

He meant `A'ishah.

I, and an Ansari neighbor of mine used to visit the Prophet in turns. He used to go one day, and I another day. When I went I would bring him the news of what had happened that day regarding the revelation and when he went, he used to do the same for me.

In those days it was rumored that the Ghassan (tribe) were preparing their horses to invade us. My companion went and returned to us at night and knocked at my door. I came out to him. He said that a grave thing happened.

I asked him, `What is it Have Ghassan come'

He replied that it was worse and more serious than that, adding that Allah's Messenger had divorced all his wives.

I said, `Hafsah is a ruined loser! I expected that would happen some day.'

So I dressed myself and I performed the Subh prayer. I went to Hafsah and found her weeping. I asked her, `Has Allah's Messenger divorced all of you'

She replied, `I don't know. He is there alone in the upper room.'

I went to the upper room and asked a black slave of the Prophet to ask for his permission to see me, and the boy went in and then came out saying, `I mentioned you to him and he remained silent.'

I then went out and came to the Minbar and found a group of people around it and some of them were weeping. I sat with them for some time, but could not endure the situation. So, I requested to the boy, `Will you get the permission for Umar?'

He went in and then came out saying, `I mentioned you to him, but he did not reply.'

So, I went to Minbar and sat with the people who were sitting by the Minbar, but I could not bear the situation, so I went to the boy again and said, `Will you get the permission for Umar?'

He went in and brought the same reply as before.

When I was leaving, behold, he called me saying, `Allah's Messenger has granted you permission.'

So, I entered the Prophet's room, greeted him with the Salam and saw him lying on a mat without bedding on it, and the mat had left its mark on the body of the Prophet.

I said, `Have you divorced your wives, O Allah's Messenger'

He raised his eyes to me and replied no.

I said, `Allahu Akbar. O Allah's Messenger! We, the people of Quraysh used to have the upper hand over our women. But when we came to Al-Madinah, we found a people whose women had the upper hand over them. Our women started learning this behavior from them. Once, I got angry with my wife, and she talked back to me. I disliked that behavior from her and she said, `Why do you dislike that I talk back to you By Allah, the Prophet's wives talk back to him and one of them would ignore him the whole day, until the night.' I said to her, `Whoever does this among them is the ruined loser! Does she feel safe from Allah getting angry with her on account of His Messenger's anger In that case, she would be ruined.'

On that the Prophet smiled.

I then said, `O Allah's Messenger! I went to Hafsah and said to her, `Do not be tempted to imitate your companion (`A'ishah) for she is more beautiful than you and more beloved to the Prophet.'

The Prophet smiled again.

When I saw him smiling, I said, `Does the Messenger feel calm?'

He said, `Yes.' So, I sat down and cast a glance at the room, and by Allah, I couldn't see anything of importance, except three hides. I said,

`Invoke Allah, O Allah's Messenger, to make your followers prosperous, for the Persians and the Byzantines have been made prosperous and given worldly luxuries, even though they do not worship Allah.'

The Prophet sat upright and said,

أَفِي شَكَ أَنْتَ يَا ابْنَ الْخَطَّابِ أُولَئِكَ قَوْمٌ عُجِّلَتْ لَهُمْ طَيِّبَاتُهُمْ فِي الْحَيَاةِ الدُّنْيَا

O Ibn Al-Khattab! Do you have any doubt These people have been given rewards of their good deeds in this world only.

I asked the Prophet, `Please beg Allah's forgiveness for me, O Allah's Messenger.'

The Prophet swore that he would not go to his wives for one month, because of his severe anger towards them, until Allah the Exalted and Most Honored censured him.''

Al-Bukhari, Muslim, At-Tirmidhi and An-Nasa'i also collected this Hadith using various chains of narration.

Al-Bukhari and Muslim also collected it from Ibn Abbas, who said,

"For a whole year, I was eager to ask `Umar bin Al-Khattab about an Ayah. However, I hesitated out of respect for him. Once, he went on a Hajj trip and I accompanied him. On our way back, he stopped to relieve himself behind some trees of Arak. I stopped until he finished and then walked along with him and asked him, `O Leader of the believers! Who are the two women who helped each other (or plotted) against the Prophet '''

This is the narration that Al-Bukhari collected, while Muslim recorded that Ibn Abbas asked,

"Who are the two women about whom Allah the Exalted said, وَإِن تَظَاهَرَا عَلَيْهِ but if you help one another against him,''

`Umar replied, "A'ishah and Hafsah.''

Muslim mentioned the rest of the Hadith.

Muslim also recorded that Ibn `Abbas said that Umar bin Al-Khattab said to him,

"When Allah's Messenger stayed away from his wives, I entered the Masjid and found people striking the ground with pebbles. They said, `Allah's Messenger has divorced his wives.' That occurred before Hijab was commanded. I said to myself, `I must investigate this news today.'''

So he mentioned the Hadith in which he went to `A'ishah and Hafsah and admonished them. He then said, `I went in and found Rabah, the servant of Allah's Messenger, sitting on a window sill. I called, `O Rabah, seek permission for me from Allah's Messenger.'''

He then mentioned the story as we mentioned above.

Umar continued,

"I said, `O Messenger of Allah, what trouble do you feel from your wives If you have divorced them, verily Allah is with you, His angels, Jibril, Mikal, I, Abu Bakr and the rest of believers are with you.' Often, when I talked, all praise is due to Allah, I hoped that Allah would testify to the words that I uttered. And so the Ayat of option was revealed.

اختلف في سبب نزول صدر هذه السورة فقيل نزلت في شأن مارية , وكان رسول الله صلى الله عليه وسلم قد حرمها فنزل قوله تعالى " يا أيها النبي لم تحرم ما أحل الله لك تبتغي مرضات أزواجك " الآية قال أبو عبد الرحمن النسائي أخبرنا إبراهيم بن يونس بن محمد حدثنا أبي حدثنا حماد بن سلمة عن ثابت عن أنس أن رسول الله صلى الله عليه وسلم كانت له أمة يطؤها فلم تزل به عائشة وحفصة حتى حرمها فأنزل الله عز وجل " يا أيها النبي لم تحرم ما أحل الله لك " إلى آخر الآية . وقال ابن جرير حدثني ابن عبد الرحيم البرقي حدثنا ابن أبي مريم ثنا أبو غسان حدثني زيد بن أسلم أن رسول الله صلى الله عليه وسلم أصاب أم إبراهيم في بيت بعض نسائه فقالت أي رسول الله في بيتي وعلى فراشي ؟ فجعلها عليه حراما قالت أي رسول الله كيف يحرم عليك الحلال ؟ فحلف لها بالله لا يصيبها فأنزل الله تعالى " يا أيها النبي لم تحرم ما أحل الله لك " قال زيد بن أسلم فقوله أنت علي حرام لغو وهكذا روى عبد الرحمن بن زيد عن أبيه وقال ابن جرير أيضا حدثنا يونس ثنا ابن وهب عن مالك عن زيد بن أسلم قال : قال لها " أنت علي حرام والله لا أطؤك " وقال سفيان الثوري عن ابن علية عن داود بن أبي هند عن الشعبي عن مسروق قال آلى رسول الله صلى الله عليه وسلم وحرم فعوتب في التحريم وأمر بالكفارة في اليمين رواه ابن جرير وكذا روي عن قتادة وغيره عن الشعبي نفسه وكذا قال غير واحد من السلف منهم الضحاك والحسن وقتادة ومقاتل بن حيان وروى العوفي عن ابن عباس قال : قلت لعمر بن الخطاب من المرأتان ؟ قال عائشة وحفصة وكان بدء الحديث في شأن أم إبراهيم مارية أصابها النبي صلى الله عليه وسلم في بيت حفصة في نوبتها فوجدت حفصة فقالت يا نبي الله لقد جئت إلي شيئا ما جئت إلى أحد من أزواجك في يومي وفي دوري وعلى فراشي قال " ألا ترضين أن أحرمها فلا أقربها " قالت بلى فحرمها وقال لها " لا تذكري ذلك لأحد " فذكرته لعائشة فأظهره الله عليه فأنزل الله تعالى " يا أيها النبي لم تحرم ما أحل الله لك تبتغي مرضات أزواجك " الآيات كلها فبلغنا أن رسول الله صلى الله عليه وسلم كفر عن يمينه وأصاب جاريته وقال الهيثم بن كليب في مسنده ثنا أبو قلابة عبد الملك بن محمد الرقاشي ثنا مسلم بن إبراهيم ثنا جرير بن حازم عن أيوب عن نافع عن ابن عمر عن عمر قال : قال النبي صلى الله عليه وسلم لحفصة " لا تخبري أحدا وإن أم إبراهيم علي حرام " فقالت أتحرم ما أحل الله لك ؟ قال " فوالله لا أقربها " قال فلم يقربها حتى أخبرت عائشة.

سورة التحريم [ مدنية وآياتها اثنتا عشرة آية ] "يا أيها النبي لم تحرم ما أحل الله لك" من أمتك مارية القبطية لما واقعها في بيت حفصة وكانت غائبة فجاءت وشق عليها كون ذلك في بيتها وعلى فراشها حيث قلت : هي حرام علي "تبتغي" بتحريمها "مرضاة أزواجك" أي رضاهن "والله غفور رحيم" غفر لك هذا التحريم

سورة التحريم مدنية في قول الجميع , وهي اثنتا عشرة آية . وتسمى سورة " النبي " . فيه خمس مسائل : الأولى : قوله تعالى : " يا أيها النبي لم تحرم ما أحل الله لك " ثبت في صحيح مسلم عن عائشة رضي الله عنها أن النبي صلى الله عليه وسلم , كان يمكث عند زينب بنت جحش فيشرب عندها عسلا , قالت فتواطأت أنا وحفصة أن أيتنا ما دخل عليها رسول الله صلى الله عليه وسلم فلتقل : إني أجد منك ريح مغافير ! أكلت مغافير ؟ فدخل على إحداهما فقالت له ذلك . فقال : ( بل شربت عسلا عند زينب بنت جحش ولن أعود له ) . فنزل : " لم تحرم ما أحل الله لك - إلى قوله - إن تتوبا " : ( لعائشة وحفصة ) , " وإذ أسر النبي إلى بعض أزواجه حديثا " [ التحريم 30 ] لقوله : ( بل شربت عسلا ) . وعنها أيضا قالت : كان رسول الله صلى الله عليه وسلم يحب الحلواء والعسل , فكان إذا صلى العصر دار على نسائه فيدنو منهن , فدخل على حفصة فاحتبس عندها أكثر مما كان يحتبس , فسألت عن ذلك فقيل لي : أهدت لها امرأة من قومها عكة من عسل , فسقت رسول الله صلى الله عليه وسلم منه شربة . فقلت : أما والله لنحتالن له , فذكرت ذلك لسودة وقلت : إذا دخل عليك فإنه سيدنو منك فقولي له : يا رسول الله , أكلت مغافير ؟ فإنه سيقول لك لا . فقولي له : ما هذه الريح ؟ - وكان رسول الله صلى الله عليه وسلم يشتد عليه أن يوجد منه الريح - فإنه سيقول لك سقتني حفصة شربة عسل . فقولي له : جرست نحله العرفط . وسأقول ذلك له , وقوليه أنت يا صفية . فلما دخل على سودة - قالت : تقول سودة والله الذي لا إله إلا هو لقد كدت أن أبادئه بالذي قلت لي , وإنه لعلى الباب , فرقا منك . فلما دنا رسول الله صلى الله عليه وسلم قالت : يا رسول الله , أكلت مغافير ؟ قال : ( لا ) قالت : فما هذه الريح ؟ قال : ( سقتني حفصة شربة عسل ) قال : جرست نحله العرفط . فلما دخل علي قلت له مثل ذلك . ثم دخل على صفية فقالت بمثل ذلك . فلما دخل على حفصة قالت : يا رسول الله , ألا أسقيك منه . قال ( لا حاجة لي به ) قالت : تقول سودة سبحان الله ! والله لقد حرمناه . قالت : قلت لها اسكتي . ففي هذه الرواية أن التي شرب عندها العسل حفصة . وفي الأولى زينب . وروى ابن أبي مليكة عن ابن عباس أنه شربه عند سودة . وقد قيل : إنما هي أم سلمة , رواه أسباط عن السدي . وقاله عطاء بن أبي مسلم . ابن العربي : وهذا كله جهل أو تصور بغير علم . فقال باقي نسائه حسدا وغيرة لمن شرب ذلك عندها : إنا لنجد منك ريح المغافير . والمغافير : بقلة أو صمغة متغيرة الرائحة , فيها حلاوة . واحدها مغفور , وجرست : أكلت . والعرفط : نبت له ريح كريح الخمر . وكان عليه السلام يعجبه أن يوجد منه الريح الطيبة أو يجدها , ويكره الريح الخبيثة لمناجاة الملك . فهذا قول . وقول آخر - أنه أراد بذلك المرأة التي وهبت نفسها للنبي صلى الله عليه وسلم فلم يقبلها لأجل أزواجه , قاله ابن عباس وعكرمة . والمرأة أم شريك . وقول ثالث - إن التي حرم مارية القبطية , وكان قد أهداها له المقوقس ملك الإسكندرية . قال ابن إسحاق : هي من كورة أنصنا من بلد يقال له حفن فواقعها في بيت حفصة . روى الدارقطني عن ابن عباس عن عمر قال : دخل رسول الله صلى الله عليه وسلم بأم ولده مارية في بيت حفصة , فوجدته حفصة معها - وكانت حفصة غابت إلى بيت أبيها - فقالت له : تدخلها بيتي ! ما صنعت بي هذا من بين نسائك إلا من هواني عليك . فقال لها : ( لا تذكري هذا لعائشة فهي علي حرام إن قربتها ) قالت حفصة : وكيف تحرم عليك وهي جاريتك ؟ فحلف لها ألا يقربها . فقال النبي صلى الله عليه وسلم : ( لا تذكريه لأحد ) . فذكرته لعائشة , فآلى لا يدخل على نسائه شهرا , فاعتزلهن تسعا وعشرين ليلة , فأنزل الله عز وجل " لم تحرم ما أحل الله لك " الآية . الثانية : أصح هذه الأقوال أولها . وأضعفها أوسطها . قال ابن العربي : " أما ضعفه في السند فلعدم عدالة رواته , وأما ضعفه في معناه فلأن رد النبي صلى الله عليه وسلم للموهوبة ليس تحريما لها , لأن من رد ما وهب له لم يحرم عليه , إنما حقيقة التحريم بعد التحليل . وأما من روى أنه حرم مارية القبطية فهو أمثل في السند وأقرب إلى المعنى , لكنه لم يدون في الصحيح . وروي مرسلا . وقد روى ابن وهب عن مالك عن زيد بن أسلم قال : حرم رسول الله صلى الله عليه وسلم أم إبراهيم فقال : ( أنت علي حرام والله لا آتينك ) . فأنزل الله عز وجل في ذلك : " يا أيها النبي لم تحرم ما أحل الله لك " وروى مثله ابن القاسم عنه . وروى أشهب عن مالك قال : راجعت عمر امرأة من الأنصار في شيء فاقشعر من ذلك وقال : ما كان النساء هكذا ! قالت : بلى , وقد كان أزواج النبي صلى الله عليه وسلم يراجعنه . فأخذ ثوبه فخرج إلى حفصة فقال لها : أتراجعين رسول الله صلى الله عليه وسلم ؟ قالت : نعم , ولو أعلم أنك تكره ما فعلت . فلما بلغ عمر أن رسول الله صلى الله عليه وسلم هجر نساءه قال : رغم أنف حفصة . وإنما الصحيح أنه كان في العسل وأنه شربه عند زينب , وتظاهرت عليه عائشة وحفصة فيه , فجرى ما جرى فحلف ألا يشربه وأسر ذلك . ونزلت الآية في الجميع . الثالثة : قوله تعالى : " لم تحرم " إن كان النبي صلى الله عليه وسلم حرم ولم يحلف فليس ذلك بيمين عندنا . ولا يحرم قول الرجل : " هذا علي حرام " شيئا حاشا الزوجة . وقال أبو حنيفة : إذا أطلق حمل على المأكول والمشروب دون الملبوس , وكانت يمينا توجب الكفارة . وقال زفر : هو يمين في الكل حتى في الحركة والكون . وعول المخالف على أن النبي صلى الله عليه وسلم حرم العسل فلزمته الكفارة . وقد قال الله تعالى : " قد فرض الله لكم تحلة أيمانكم " [ التحريم : 2 ] فسماه يمينا . ودليلنا قول الله تعالى : " يا أيها الذين آمنوا لا تحرموا طيبات ما أحل الله لكم ولا تعتدوا " [ المائدة : 87 ] , وقوله تعالى : " قل أرأيتم ما أنزل الله لكم من رزق فجعلتم منه حراما وحلالا قل آلله أذن لكم أم على الله تفترون " [ يونس : 59 ] . فذم الله المحرم للحلال ولم يوجب عليه كفارة . قال الزجاج : ليس لأحد أن يحرم ما أحل الله . ولم يجعل لنبيه صلى الله عليه وسلم أن يحرم إلا ما حرم الله عليه . فمن قال لزوجته أو أمته : أنت علي حرام ; ولم ينو طلاقا ولا ظهارا فهذا اللفظ يوجب كفارة اليمين . ولو خاطب بهذا اللفظ جمعا من الزوجات والإماء فعليه كفارة واحدة . ولو حرم على نفسه طعاما أو شيئا آخر لم يلزمه بذلك كفارة عند الشافعي ومالك . وتجب بذلك كفارة عند ابن مسعود والثوري وأبي حنيفة . الرابعة : واختلف العلماء في الرجل يقول لزوجته : " أنت علي حرام " على ثمانية عشر قولا : أحدها : لا شيء عليه . وبه قال الشعبي ومسروق وربيعة وأبو سلمة وأصبغ . وهو عندهم كتحريم الماء والطعام ; قال الله تعالى : " يا أيها الذين آمنوا لا تحرموا طيبات ما أحل الله لكم " [ المائدة : 87 ] والزوجة من الطيبات ومما أحل الله . وقال تعالى : " ولا تقولوا لما تصف ألسنتكم الكذب هذا حلال وهذا حرام " [ النحل : 116 ] . وما لم يحرمه الله فليس لأحد أن يحرمه , ولا أن يصير بتحريمه حراما . ولم يثبت عن رسول الله صلى الله عليه وسلم أنه قال لما أحله الله هو علي حرام . وإنما امتنع من مارية ليمين تقدمت منه وهو قوله : ( والله لا أقربها بعد اليوم ) فقيل له : لم تحرم ما أحل الله لك ; أي لم تمتنع منه بسبب اليمين . يعني أقدم عليه وكفر . ثانيها : أنها يمين يكفرها ; قاله أبو بكر الصديق وعمر بن الخطاب وعبد الله بن مسعود وابن عباس وعائشة - رضي الله عنهم - والأوزاعي ; وهو مقتضى الآية . قال سعيد بن جبير عن ابن عباس : إذا حرم الرجل عليه امرأته فإنما هي يمين يكفرها . وقال ابن عباس : لقد كان لكم في رسول الله أسوة حسنة ; يعني أن النبي صلى الله عليه وسلم كان حرم جاريته فقال الله تعالى : " لم تحرم ما أحل الله لك - إلى قوله تعالى - قد فرض الله لكم تحلة أيمانكم " فكفر عن يمينه وصير الحرام يمينا . خرجه الدارقطني . ثالثها أنها تجب فيها كفارة وليست بيمين ; قاله ابن مسعود وابن عباس أيضا في إحدى روايتيه , والشافعي في أحد قوليه , وفي هذا القول نظر . والآية ترده على ما يأتي . رابعها : هي ظهار ; ففيها كفارة الظهار , قاله عثمان وأحمد بن حنبل وإسحاق . خامسها أنه إن نوى الظهار وهو ينوي أنها محرمة كتحريم ظهر أمه كان ظهارا . وإن نوى تحريم عينها عليه بغير طلاق تحريما مطلقا وجبت كفارة يمين . وإن لم ينو شيئا فعليه كفارة يمين , قاله الشافعي . سادسها : أنها طلقة رجعية , قاله عمر بن الخطاب والزهري وعبد العزيز بن أبي سلمة وابن الماجشون . وسابعها أنها طلقة بائنة , قاله حماد بن أبي سليمان وزيد بن ثابت . ورواه ابن خويز منداد عن مالك . ثامنها أنها ثلاث تطليقات , قاله علي بن أبي طالب وزيد بن ثابت أيضا وأبو هريرة . تاسعها : هي في المدخول بها ثلاث , وينوي في غير المدخول بها , قاله الحسن وعلي بن زيد والحكم . وهو مشهور مذهب مالك . عاشرها : هي ثلاث ; ولا ينوي بحال ولا في محل وإن لم يدخل ; قاله عبد الملك في المبسوط , وبه قال ابن أبي ليلى . حادي عشرها : هي في التي لم يدخل بها واحدة , وفي التي دخل بها ثلاث ; قاله أبو مصعب ومحمد بن عبد الحكم . ثاني عشرها أنه إن نوى الطلاق أو الظهار كان ما نوى . فإن نوى الطلاق فواحدة بائنة إلا أن ينوي ثلاثا . فإن نوى ثنتين فواحدة . فإن لم ينو شيئا كانت يمينا وكان الرجل موليا من امرأته ; قاله أبو حنيفة وأصحابه . وبمثله قال زفر ; إلا أنه قال : إذا نوى اثنتين ألزمناه . ثالث عشرها أنه لا تنفعه نية الظهار وإنما يكون طلاقا ; قاله ابن القاسم . رابع عشرها : قال يحيى بن عمر : يكون طلاقا ; فإن ارتجعها لم يجز له وطؤها حتى يكفر كفارة الظهار . خامس عشرها : إن نوى الطلاق فما أراد من أعداده . وإن نوى واحدة فهي رجعية . وهو قول الشافعي رضي الله عنه . وروي مثله عن أبي بكر وعمر وغيرهم من الصحابة والتابعين . سادس عشرها : إن نوى ثلاثا فثلاثا , وإن واحدة فواحدة . وإن نوى يمينا فهي يمين . وإن لم ينو شيئا فلا شيء عليه . وهو قول سفيان . وبمثله قال الأوزاعي وأبو ثور ; إلا أنهما قالا : إن لم ينو شيئا فهي واحدة . سابع عشرها : له نيته ولا يكون أقل من واحدة ; قاله ابن شهاب . وإن لم ينو شيئا لم يكن شيء ; قاله ابن العربي . ورأيت لسعيد بن جبير وهو : الثامن عشر أن عليه عتق رقبة وإن لم يجعلها ظهارا . ولست أعلم لها وجها ولا يبعد في المقالات عندي . قلت : قد ذكره الدارقطني في سننه عن ابن عباس فقال : حدثنا الحسين بن إسماعيل قال حدثنا محمد بن منصور قال حدثنا روح قال : حدثنا سفيان الثوري عن سالم الأفطس عن سعيد بن جبير عن ابن عباس أنه أتاه رجل فقال : إني جعلت امرأتي علي حراما . فقال : كذبت ! ليست عليك بحرام ; ثم تلا " يا أيها النبي لم تحرم ما أحل الله لك " عليك أغلظ الكفارات : عتق رقبة . وقد قال جماعة من أهل التفسير : إنه لما نزلت هذه الآية كفر عن يمينه بعتق رقبة , وعاد إلى مارية صلى الله عليه وسلم ; قاله زيد بن أسلم وغيره . الخامسة : قال علماؤنا : سبب الاختلاف في هذا الباب أنه ليس في كتاب الله ولا في سنة رسول الله صلى الله عليه وسلم نص ولا ظاهر صحيح يعتمد عليه في هذه المسألة , فتجاذبها العلماء لذلك . فمن تمسك بالبراءة الأصلية فقال : لا حكم , فلا يلزم بها شيء . وأما من قال إنها يمين ; فقال : سماها الله يمينا . وأما من قال : تجب فيها كفارة وليست بيمين ; فبناه على أحد أمرين : أحدهما أنه ظن أن الله تعالى أوجب الكفارة فيها وإن لم تكن يمينا . والثاني أن معنى اليمين عنده التحريم , فوقعت الكفارة على المعنى . وأما من قال : إنها طلقة رجعية ; فإنه حمل اللفظ على أقل وجوهه , والرجعية محرمة الوطء كذلك ; فيحمل اللفظ عليه . وهذا يلزم مالكا , لقوله : إن الرجعية محرمة الوطء . وكذلك وجه من قال : إنها ثلاث , فحمله على أكبر معناه وهو الطلاق الثلاث . وأما من قال : إنه ظهار , فلأنه أقل درجات التحريم , فإنه تحريم لا يرفع النكاح . وأما من قال : إنه طلقة بائنة , فعول على أن الطلاق الرجعي لا يحرم المطلقة , وأن الطلاق البائن يحرمها . وأما قول يحيى بن عمر فإنه احتاط بأن جعله طلاقا , فلما ارتجعها احتاط بأن يلزمه الكفارة . ابن العربي : " وهذا لا يصح , لأنه جمع بين المتضادين , فإنه لا يجتمع ظهار وطلاق في معنى لفظ واحد , فلا وجه للاحتياط فيما لا يصح اجتماعه في الدليل . وأما من قال : إنه ينوى في التي لم يدخل بها , فلأن الواحدة تبينها وتحرمها شرعا إجماعا . وكذلك قال من لم يحكم باعتبار نيته : إن الواحدة تكفي قبل الدخول في التحريم بالإجماع , فيكفي أخذا بالأقل المتفق عليه . وأما من قال : إنه ثلاث فيهما , فلأنه أخذ بالحكم الأعظم , فإنه لو صرح بالثلاث لنفذت في التي لم يدخل بها نفوذها في التي دخل بها . ومن الواجب أن يكون المعنى مثله وهو التحريم " . والله أعلم . وهذا كله في الزوجة . وأما في الأمة فلا يلزم فيها شيء من ذلك , إلا أنه ينوي به العتق عند مالك . وذهب عامة العلماء إلى أن عليه كفارة يمين . ابن العربي . والصحيح أنها طلقة واحدة , لأنه لو ذكر الطلاق لكان أقله وهو الواحدة إلا أن يعدده . كذلك إذا ذكر التحريم يكون أقله إلا أن يقيده بالأكثر , مثل أن يقول أنت علي حرام إلا بعد زوج , فهذا نص على المراد . قلت : أكثر المفسرين على أن الآية نزلت في حفصة لما خلا النبي صلى الله عليه وسلم في بيتها بجاريته ; ذكره الثعلبي . وعلى هذا فكأنه قال : لا يحرم عليك ما حرمته على نفسك ولكن عليك كفارة يمين , وإن كان في تحريم العسل والجارية أيضا . فكأنه قال : لم يحرم عليك ما حرمته , ولكن ضممت إلى التحريم يمينا فكفر عن اليمين . وهذا صحيح , فإن النبي صلى الله عليه وسلم حرم ثم حلف , كما ذكره الدارقطني . وذكر البخاري معناه في قصة العسل عن عبيد بن عمير عن عائشة قالت : كان رسول الله صلى الله عليه وسلم يشرب عند زينب بنت جحش عسلا ويمكث عندها , فتواطأت أنا وحفصة على أيتنا دخل عليها فلتقل : أكلت مغافير ؟ إني لأجد منك ريح مغافير ! قال : ( لا ولكن شربت عسلا ولن أعود له وقد حلفت لا تخبري بذلك أحدا ) . يبتغي مرضات أزواجه . فيعني بقوله : ( ولن أعود له على جهة التحريم . وبقوله : ( حلفت ) أي بالله , بدليل أن الله تعالى أنزل عليه عند ذلك معاتبته على ذلك , وحوالته على كفارة اليمين بقوله تعالى : " يا أيها النبي لم تحرم ما أحل الله لك " يعني العسل المحرم بقوله : ( لن أعود له ) . " تبتغي مرضات أزواجك " أي تفعل ذلك طلبا لرضاهن . " والله غفور رحيم " غفور لما أوجب المعاتبة , رحيم برفع المؤاخذة . وقد قيل : إن ذلك كان ذنبا من الصغائر . والصحيح أنه معاتبة على ترك الأولى , وأنه لم تكن له صغيرة ولا كبيرة .
